Website terms and conditions
1.1.
Service Provider reserves the right, in its sole
discretion, to amend and/or replace any of, or the whole of, the Terms. Such
amendments shall supersede and replace any previous Terms and shall be made
available on the Website.
1.2.
If there is anything in these Terms that you do
not understand, then please contact us as soon as possible see below for
contact details.
1.3.
Service Provider reserves the right to change
and amend the products, prices and rates quoted on this Website from time to
time without notice.
1.4.
Service Provider may use the services of third
parties to provide information on the Website. Service Provider has no control
over this information and makes no representations or warranties of any nature
as to its accuracy, appropriateness, or correctness. The user agrees that such
information is provided “as is” and that Service Provider and its online
partners shall not be liable for any losses or damages that may arise from the
user’s reliance on it, howsoever these may arise.
1.5.
Service Provider makes no representations or
warranties, whether express or implied, as to the accuracy, completeness or
reliability of any information, data and/or content on the Website.
1.6.
You may not utilise the Website in any manner
which may compromise the security of Service Provider’s networks or tamper with
the Website in any manner whatsoever, which shall include without limitation,
gaining or attempting to gain unauthorised access to the Website, or delivering
or attempting to deliver any unauthorised, damaging or malicious code to the
Website, all of which is expressly prohibited. Any person or entity which does
so, or attempts to do so, shall be held criminally liable. Further, should
Service Provider suffer any damage or loss, civil damages shall be claimed by
Service Provider against the user.
1.7.
Any user who commits any of the offences
detailed in Chapter 13 of the Electronic Communications and Transactions Act 25
of 2002 (“ECTA”) (specifically sections 85 to 88 (inclusive)) shall,
notwithstanding criminal prosecution, be liable for all resulting liability,
loss or damages suffered and/or incurred by Service Provider and its
affiliates, agents and/or partners.
1.8.
All copyright and other intellectual property
rights in all content, trademarks, software, data, material, including logos,
databases, text, graphics, icons, hyperlinks, confidential information,
designs, agreements, and multimedia works, published on or via the Website
(“proprietary material”), are the property of, or are licensed to, Service
Provider and as such are protected from infringement by local and international
legislation and treaties.
1.9.
By submitting reviews, comments and/or any other
content (other than your personal information) to Service Provider for posting
on the Website, you automatically grant Service Provider and its affiliates a
nonexclusive, royalty free, perpetual, irrevocable right and licence to use,
reproduce, publish, translate, sublicense, copy and distribute such content in
whole or in part worldwide, and to incorporate it in other works in any form,
media, or technology now known or hereinafter developed, for the full term of
any copyright that may exist in such content. Subject to this licence, you
retain any and all rights that may exist in such content.
1.10.
Neither the service provider, its affiliates,
shareholders, agents, consultants or employees shall be liable for any damages
whatsoever, including without limitation any direct, indirect, special,
incidental, consequential or punitive damages, howsoever arising (whether in an
action arising out of contract, statute, delict or otherwise) related to the
use of, or the inability to access or use the content of the website or any
functionality thereof, or the information contained on the website, or of any linked
website, even if service provider knows or should reasonably have known or is
expressly advised thereof.
1.11.
Service provider makes no warranty or
representation as to the availability, accuracy or completeness of the content
of the website. You expressly waive and renounce all your rights of whatever
nature that you may have against service provider for any LOSS suffered by you,
as a result of information supplied by service provider being incorrect,
incomplete, or inaccurate.
1.12.
You represent that if you are an individual, you
are of legal age to enter into a binding contract, or that if you are
registering on behalf of a legal entity, that you are authorized to enter into,
and bind the entity to, these User Terms and register for the Service and the
Application.
1.13.
By ordering the laundry services as provided by
the Laundry Studio you confirm that you have read and agreed to the terms and
conditions as set out herein.
2.
Pickup and Delivery
2.1.
Pick-up and delivery may be requested through
our Website/ Phone/ Whatsapp.
2.2.
Our goal is to provide valuable and timely
service to all our customers and partners. Therefore, you can edit the time of
a pickup up to 30 minutes before the requested pickup time and you can freely
reschedule a delivery prior to 3pm for any delivery during office hours and
prior to 7am for any morning delivery. If you cancel a pickup less than 30
minutes before your requested time, rescheduled a delivery after the designated
time for change, or if our partners cannot deliver or pickup an order because
you or your designee failed to appear, we may charge a cancellation fee in a
reasonable amount. Please note we are closed on A Saturday Afternoon
till Monday morning. All orders received on a Saturday will only be available
for delivery late Monday or early Tuesday.
3.
Turnaround Time
3.1.
The Laundry Studio endeavours to deliver within
48 hours most of the orders. However, in the case that some items require any
extra care (e.g., items that cannot be tumble dried and items that need special
stain treatments), We reserves its right to delay delivery up to a reasonable
time. If, for this reason, we cannot deliver at the agreed drop off time, We
will contact you to re-arrange the drop-off time.
4.
Garment Care
4.1.
We wash all items together as our standard
procedure. If you want your colours separated, you must divide your
clothes into two separate bags before your pick-up. Note that we do
not separate clothes and ask that you do the separation and take responsibility
for what's in each load.
4.2.
We are not responsible for your laundry items
bleeding, shrinking, fading, or otherwise becoming altered or becoming worn out
by the normal wash-and-dry laundry process. We are also not responsible for any
damage from a garment that bleeds the first time it was washed if we were not
informed that it was new. The Laundry Studio will not be responsible for any
damage that is done to your laundry during normal washing and drying. The
Laundry Studio is not responsible for any items labelled HAND WASH ONLY, HANG
DRY/DRY FLAT, DO NOT USE HEAT, DRY CLEAN ONLY, or any other “special care”
instructions unless this has been specifically requested and itemised
accordingly.
4.3.
In the absence of this or based on customers
instructions contrary to this we will not be liable if the chosen method
damages your clothes.
5.
Damage to items
5.1.
You shall be responsible for ensuring that any
items you have arranged to be collected are suitable for the Services.
Furthermore, you should ensure any pockets etc. of any items you pass to us
have been checked to be empty. We are not responsible for loose items such as
jewellery, watches, cash, detachable buttons, cufflinks, etc. We cannot be held
responsible for damage to your garments from items left in pockets (Lipstick,
Gum, Pens, Paper, etc).
5.2.
Any lost items (online) must be reported within
2 business days. The Laundry Studio makes its best reasonable effort to track
items that we process and will review all lost items, an amount determined on
value, age, wear and tear will be established and paid out in the event of loss
, if the customer has furnished The Laundry Studio with an inventory (itemised)
on the date of pick up and items on that inventory is lost. If an inventory is
not furnished, The Laundry Studio cannot be held responsible for any lost
items. All decisions on lost items are in The Laundry Studios sole discretion
and are final. On the basis of any claim, we shall consider all
articles to be secondhand and such liability shall be limited to 5 times the
cleaning amount
5.3.
In Store - Loss and Damage Policy: It states
clearly on the counter that ALL orders are to be checked by customer upon
collection of his items, no responsibility will be held once the items leave
the shop premises. With NO Exceptions, We will investigate any complaint
promptly and pay fair compensation for damage or loss due to our negligence
5.4.
The Laundry Studio cannot assume responsibility
for inherent weaknesses or defects in materials which may result in tears or
development of small holes in fabric that are not readily apparent prior to
processing.
5.5.
Per industry standards, the following are
considered normal wear and tear:
5.5.1.
Shrinkage from repeated laundering
5.5.2.
Curtain shrinkage
5.5.3.
Colour fading, Discoloration caused by hygiene
or beauty products
5.5.4.
Small holes or tears
5.5.5.
Button damage
5.5.6.
Thinning of fabric
6.
Payment on Dropoff
6.1.
The Laundry Studio will not release any laundry
unless payment is performed in advance of delivery/ drop-off. Should you need
to pay via EFT, a proof of payment will be required. The driver is not allowed
to release the laundry unless a valid payment is made.
6.2.
Garment Storage: We will only store
unpaid items for a maximum of 3 months and pre-paid items for 6 months
after which they will be disposed of without warning to a charity shop.
6.3.
Complaints: If you are not satisfied
with the quality of our cleaning, please contact us within 24 hrs. If
appropriate we shall reprocess your garment at no extra cost.
6.4.
Care Label Instructions: We exercise
great care in processing your articles and use methods best suited to the
nature and condition of each article. We clean in accordance with the care
label instructions. In the absence of this we will not be liable if the
chosen method damages your clothes.
6.5.
Repairs & Alterations: Before
going ahead with a repair or alteration for which you will be charged, we will
check with you to confirm the price.
6.6.
Limitations: Despite our intent to
identify problem items in advance, we cannot assume responsibility for inherent
weaknesses/ defects in materials that are not apparent prior to cleaning. We
are not responsible for sun fading, colour loss due to non-fastness, buttons,
belt buckles, wear and tear and shrinkage.
6.7.
Suede & Leather: Suede & leather
garments are examples of materials that have inherent weaknesses or defects in
the material. They are subject to natural flaws. We cannot take responsibility
for colour imbalance or shrinkages.
6.8.
Silk: This item given the fact that
it is a specialised and unique material that is easily damaged (particularly
when one has tried to clean it at home) is subject to pre-inspection and a
disclaimer is issued advising you of potential risk to the product. Please be
sure to itemise this item and get pre-inspection form.
6.9.
Stain Removal: We aim to remove all
stains but, in some cases, this is not possible. The chances of stain removal
are reduced if any non-professional techniques have been applied such as the
use of water or soda. We treat problematic stains with great caution but
sometimes to achieve results we need to use harsher techniques and chemicals.
Should the need arise, we will contact you before going ahead as certain stain
removals can only be done at the customer’s own risk. We may not be able to
guarantee the results.
6.10.
Curtain Cleaning Service: Dry
cleaning curtains involve movement in the processing. This can exaggerate
weaknesses in your curtains - for example sun damaged linings can tear and sun
damaged colours can lighten. Most curtains shrink approx. 3-5% in cleaning
especially if cleaned for the first time or if they have interlining, however
they can shrink up to 10% depending on the material. It is important to note
that curtains not pre-shrunk by the manufacturer can shrink up to 30% and this
is not reversible, it is important to check labels to ensure your curtains have
been pre-shrunk. Black (Block) out linings can only be accepted at owners’
risk - there is a risk of the rubberised part de-laminating.
(Specialist cleaning only with its lower temperatures) Curtains with water
damage are unlikely to return like new after cleaning. Water marks
are usually ringed and set in with time and are not normally possible to
remove.
6.11.
Service (Load) Washes (non-itemised): Please
note that all items deposited under a service wash will be washed at 40 degrees
and tumble dried at 65 degrees regardless of what the individual garments care
labels may state. It is then the customer’s responsibility to ensure all
garments deposited can withstand the stated method. No responsibility will be
taken for any items damaged or lost when deposited as service washes as no
items are checked or counted on deposit.
6.12.
Dyeing has RISKS: We will
advise and help to minimise risk but will not accept liability for faults
related to the fabric or if there the fabric has any of the following below.
Only natural fibres may be dyed Examples of these are cotton, denim, natural
viscose, linen, flax, and hemp. Wool is a natural fibre however there are high
risks with this and should be avoided. Garments made from a mixture of natural
fibres and man-made materials such as polyester will not dye properly.
Stitching made using man-made fibres will not dye. Age of fabric, type of
fabric, existing colour, stains, and flaws – all affect the outcome. Dye will
not cover paint stains, glue, varnish, silicone, or nail polish. Body sweat,
roll-on deodorants, antiperspirant and perfumes cause fibre damage and may
result in black smear marks. Fabric exposed to external factors such as
sunlight on curtains and human excretions on sheets may dye unevenly.
